Section 1 in the 14th amendment stating that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." The clause in that section, "subject to the jurisdiction thereof" is the one piece of the amendment republicans are trying to use to dismiss children who aren't born of citizens.
The problem with that is the clause itself was inserted into the 14th amendment by it's author, "Defining Jurisdiction: Senator Jacob Howard, who introduced the clause, clarified it was intended to exclude only those foreigners or aliens belonging to the family of ambassadors or foreign ministers and not otherwise subject to U.S. laws."-Google. This wording came after some debate as to what the intent of subject to the jurisdiction thereof should mean. What seems the intent is that persons who owe allegiance to another power are not granted birthright citizenship nor children born from foreign diplomats. the intent of the clause is clear here and has been interpreted as such for more than 150 years.
Now republicans are trying to pretzel the logic of the 1866 14th amendment away from it's original intent toward their own narrative of only applying to former slaves. But the intent was to give birthright citizenship to all who are born or naturalized citizens including former slaves. The republican party is a scourge looking to apply it's plague upon we the people who have been here on this land for millenniums. Instead of trying to entice our votes because of policy they are instead trying to winnow down the voting pool so as to keep power. They are not about we the people and instead are about power and control over we the people!
This blog will be an advocate for compassion, curiosity and human survival. When these elements of human nature are being denied, wholly, severally or individually, less than positive human traits are the outcome. It is my wish and hope that my reasonings on a variety of subjects will provide the readers of this blog with personal and public insights.
