It is all up to the courts now. The new injunction to stop the trump postal service rule was filed last Thursday, and the department of justice, ie... trump, appealed yesterday. So now the courts will expedite their decisions. first the appellate court will issue their legal finding and then that decision will be appealed to the supreme court. It is happening as fast as I anticipated since some mail in ballots go out overseas on September 4th, There is no room to spare with everything considered. The 1st circuit court of appeals will hear this appeal and should move swiftly to uphold the injunction. I say that because the 1st circuit court of appeals is not beholden to trump only their duty to the constitution.
The logic for a quick decision by the appellate court lies with the immediacy of an election coming very soon. The appellate court also is aware of the supreme court having already laid some guidelines for this by removing an injunction while also keeping the other injunction. So the path is clear for the appellate court to give their reasoned logic to their conclusion. The appellate court could also stay the injunction temporarily while they decide their outcome but I don't think they will if they are already close to a decision. Deciding these injunctions is not as difficult as some may think. However the wording of the solution by the appellate court is highly important as to explaining the law on this postal rule. We will get the gist of how this should be decided through the interpretation the appellate court offers.
This isn't rocket science here. Article 1 Section 4 is quite explicit as to who runs elections and not once does the executive branch come into it. So trump demanding that he be given authority beyond the express written consent of our constitution is not only a non starter but begs the question as to his motive. The supreme court is not a stupid entity. They know what they are doing and if the 6 republican majority on the supreme court rule against any core constitutional law outside the process for amending our constitution then Pandora's box of consequences will be the result. If the republican majority supreme court cannot hold the sanctity of our constitution dear then they are acting outside their authority to adjudicate!
